一、海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院概況
2020年12月31日，海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院正式揭牌辦公。海南成為繼北京、上海、廣東之后，全國(guó)第四個(gè)擁有專(zhuān)門(mén)知識(shí)產(chǎn)權(quán)法院的省份。海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院設(shè)立案庭、審判第一庭、審判第二庭、審判第三庭、執(zhí)行局5個(gè)業(yè)務(wù)庭，設(shè)立審判事務(wù)部、政治部2個(gè)行政機(jī)構(gòu)。海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院推行知識(shí)產(chǎn)權(quán)民事、行政、刑事案件“三合一”審判模式和立案、審判、執(zhí)行“三合一”全流程辦理。
海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院堅(jiān)持“高站位、高標(biāo)準(zhǔn)、高起點(diǎn)、高水平”的標(biāo)準(zhǔn),打造知識(shí)產(chǎn)權(quán)司法保護(hù)新高地,努力向著建設(shè)國(guó)際一流知識(shí)產(chǎn)權(quán)法院的目標(biāo)邁進(jìn)，為推動(dòng)海南自由貿(mào)易港形成法治化、國(guó)際化和便利化的營(yíng)商環(huán)境提供強(qiáng)有力的司法保障。

Introduction
Hainan Free Trade Port Intellectual Property Court (hereinafter called the Court) was formally inaugurated on December 31, 2020, and Hainan has then become the fourth province with a special intellectual property court after Beijing, Shanghai and Guangdong in China.?The Court is constituted by Case Filing Division, The First Division, The Second Division, The Third Division, Enforcement Bureau, Department of Trial Affairs and Political Department.?The Court implements a "three in one" trial mode where it conducts centralized trials of civil, administrative and criminal intellectual property(IP) cases and a "three in one" litigation process integrating case filing, trial and enforcement.
The Court insists on high position, high standard, high starting point and high level to build Hainan into a new highland?of IP?judicial protection. Furthermore, the Court will strive to become a world-class court so as to provide powerful judicial protection for creating a legal, international and convenient business environment?in?Hainan free trade port.
二、海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院管轄范圍
海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院管轄以下案件：
一、海南省有關(guān)專(zhuān)利、技術(shù)秘密、計(jì)算機(jī)軟件、植物新品種、集成電路布圖設(shè)計(jì)、涉及馳名商標(biāo)認(rèn)定及壟斷糾紛等專(zhuān)業(yè)性、技術(shù)性較強(qiáng)的第一審知識(shí)產(chǎn)權(quán)民事、行政案件；
二、前項(xiàng)規(guī)定以外的由海南省的中級(jí)人民法院管轄的第一審知識(shí)產(chǎn)權(quán)民事、行政和刑事案件；
三、海南省基層人民法院第一審知識(shí)產(chǎn)權(quán)民事、行政和刑事判決、裁定的上訴、抗訴案件；
四、最高人民法院確定由海南自由貿(mào)易港知識(shí)產(chǎn)權(quán)法院管轄的其他案件。
Jurisdiction
Hainan Free Trade Port Intellectual Property Court shall have jurisdiction over the following cases:
1.First-instance civil and administrative intellectual property(IP) cases which involve highly professional and technical knowledge, such as cases involving patents, technical trade secrets, computer software, new plant varieties, integrated circuit layout design, well-known trademark recognition or monopoly disputes in Hainan;
2.Besides the preceding clause, first-instance civil, administrative and criminal IP cases under the jurisdiction of the intermediate people's courts in Hainan;
3.Appeals or protests against the first-instance civil, administrative and criminal IP judgements and orders of the primary people's courts in Hainan;
4.Cases as determined by the Supreme People's Court to be under the jurisdiction of Hainan Free Trade Port Intellectual Property Court.
